IMPORTANT LEGAL NOTICE: PLEASE READ THESE TERMS OF SERVICE CAREFULLY AS THEY CONTAIN BINDING LEGAL OBLIGATIONS AND AFFECT YOUR LEGAL RIGHTS. THIS INCLUDES A MANDATORY ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT DICTATE HOW DISPUTES BETWEEN YOU AND BOVADA WILL BE RESOLVED.
1. Introduction and Acceptance of Terms
Welcome to Bovada (the "Company," "we," "us," or "our"). These Terms of Service (the "Terms", "Agreement") constitute a legally binding agreement between you (the "User," "Player," "Customer," or "you") and Bovada governing your access to and use of the Bovada website, mobile applications, and any related games, sportsbook features, poker rooms, racebooks, content, features, and services offered by us (collectively, the "Services").
By registering for an account, accessing the website, downloading our application, depositing funds, or otherwise using the Services, you unequivocally acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Anti-Money Laundering (AML) Policy, and any specific betting rules applicable to the products you use. If you do not agree to these Terms in their absolute entirety, you are strictly prohibited from using the Services and must discontinue use immediately.
We reserve the right to amend, update, or modify these Terms at any time without prior individual notice. When material changes are made, we will update the "Last Updated" date at the top of this document. Your continued use of the Services after any such modifications constitutes your formal acceptance of the new Terms. It is your sole responsibility to review this page periodically.
2. Eligibility and Account Registration
2.1 Age and Jurisdictional Requirements
To use the Services, you must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction of residence, whichever is strictly higher. Underage gambling is a serious criminal offense. We do not knowingly permit minors to open accounts. By using the Services, you represent and warrant that you meet this age requirement.
Furthermore, you are solely responsible for verifying the gambling laws in your specific jurisdiction prior to registering an account. You may not use the Services if you reside in a state, province, or country where online gambling or the specific services we offer are expressly prohibited by law. We actively block IP addresses from restricted jurisdictions and reserve the right to close accounts originating from these areas without notice.
2.2 Account Creation and Verification
In order to place real-money wagers, you must register and create a player account ("Account"). You agree to provide accurate, current, and verifiable information during the registration process, including your true legal name, date of birth, residential address, and a valid email address.
We are bound by international Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations. Therefore, we reserve the right to demand verification of your identity, age, and physical address at any time. This may require you to submit high-quality photographic copies of government-issued identification (e.g., driver's license or passport), recent utility bills, and potentially photographs of the credit/debit cards used to fund your account. Failure to provide satisfactory documentation within a requested timeframe will result in the immediate suspension of your Account and the forfeiture of any pending withdrawals.
2.3 Account Security
You are solely and entirely responsible for maintaining the confidentiality of your Account login credentials, including your username, password, and any two-factor authentication (2FA) codes. You accept full responsibility for all activities, wagers, and transactions that occur under your Account, whether authorized by you or not. Bovada will not be held liable for any loss or damage arising from your failure to adequately safeguard your account details. If you suspect your account has been compromised, you must notify Customer Support immediately.
2.4 Prohibition of Multiple Accounts
You are strictly permitted to open and maintain only one (1) Account per person, per household, per IP address, and per device. The creation of multiple accounts—often referred to as "multi-accounting" or "gnoming"—is strictly prohibited. If we discover that you have opened multiple accounts to circumvent betting limits, abuse promotional bonuses, or manipulate the platform, we reserve the immediate right to permanently ban all associated accounts, void all active wagers, and confiscate any account balances, winnings, and bonuses contained therein.
3. Virtual Currency, Deposits, and Withdrawals
3.1 Funding Your Account
You may fund your Account using the deposit methods provided on the platform, which may include major credit/debit cards, bank transfers, and accepted cryptocurrencies (such as Bitcoin, Ethereum, Litecoin, and Tether). The name on the credit card or financial account used to deposit must perfectly match the legal name registered on your Bovada Account. Third-party deposits are explicitly forbidden and will be rejected.
3.2 Cryptocurrencies
Bovada actively encourages the use of cryptocurrency for its speed and security. When depositing via cryptocurrency, it is your absolute responsibility to ensure that you are sending the funds to the correct, newly generated wallet address provided by our cashier system, and that you are sending the correct cryptocurrency asset on the correct network (e.g., sending ERC-20 tokens only to an ERC-20 address). Bovada assumes zero liability for funds lost due to user error, including sending funds to incorrect addresses or utilizing incorrect blockchain networks.
3.3 Withdrawals and Payouts
You may request a withdrawal of your available real-money balance at any time, subject to our processing times and withdrawal limits. Withdrawals are generally processed back to the original method used for deposit, at our discretion. If you deposit via cryptocurrency, your withdrawal will be processed via cryptocurrency. We reserve the right to process large withdrawals in installments.
Before any withdrawal is approved, your account must be fully KYC verified, and you must have completed any applicable "rollover" or "playthrough" requirements associated with bonuses or recent deposits. (A standard 1x rollover of deposited funds is required to satisfy anti-money laundering protocols before a withdrawal is permitted, even if no bonus was claimed).
3.4 Chargebacks and Fraudulent Transactions
If you initiate a chargeback, dispute, or reversal of a deposit made to your Account, this constitutes a severe breach of this Agreement. We reserve the right to immediately suspend your Account, aggressively dispute the chargeback with the payment provider utilizing your IP address and betting logs, and confiscate any winnings derived from the disputed funds. Furthermore, we reserve the right to utilize third-party collection agencies to recover any negative balances resulting from chargebacks.
4. Rules of Conduct and Prohibited Activities
Bovada is committed to maintaining a fair, secure, and respectful gaming environment. By using the Services, you explicitly agree that you will NOT engage in any of the following prohibited activities:
- Cheating and Collusion: You may not cheat, collude with other players, or manipulate the outcome of any game or sporting event. This includes "chip dumping" in poker, soft-playing, or sharing hole card information.
- Use of Bots and Artificial Intelligence: The use of automated software, "bots," macros, artificial intelligence (AI), real-time assistance (RTA) software, or any other unauthorized third-party programs designed to make decisions for you or play without human intervention is strictly forbidden.
- Exploiting Software Bugs: You may not exploit, or attempt to exploit, any bug, glitch, error, or loophole in the platform's software or sportsbook lines for financial gain. If you encounter an obvious error (such as a drastically incorrect point spread), you must report it to Customer Support. Wagers placed on obvious "bad lines" will be voided.
- Arbitrage and Syndicate Betting: We reserve the right to restrict or close the accounts of players whom we identify as engaging in professional syndicate betting, systematic arbitrage betting ("arbing"), or acting in concert with others to exploit market vulnerabilities.
- Money Laundering: You may not use the platform as a mechanism to mix, mask, or transfer funds originating from illicit activities.
- Abusive Behavior: You may not use offensive, racist, sexist, threatening, or vulgar language in our poker chat rooms, live dealer chats, or in communications with our Customer Support agents. Abusive behavior will result in chat bans or complete account closure.
5. Sportsbook and Racebook Rules
5.1 Acceptance of Wagers
A wager is only deemed valid and accepted once it is confirmed and recorded in our internal database. You are solely responsible for verifying the accuracy of your bet slip before clicking "Place Bet." Once a bet is confirmed, it cannot be canceled, amended, or revoked by the user under any circumstances.
5.2 Settlement and Grading
Sportsbook wagers are settled strictly based on the official results declared by the governing regulatory body of the respective sport (e.g., the NFL, NBA, FIFA). We do not recognize overturned decisions, subsequent disqualifications, or protested results made after the conclusion of the event for grading purposes. We reserve the right to delay the settlement of a wager pending an official ruling or investigation.
5.3 Postponed, Canceled, and Abandoned Events
If a sporting event is canceled, abandoned, or significantly postponed, the treatment of wagers will follow the specific rules established for that particular sport (detailed in our Sportsbook Rules section). Generally, if an event is not completed within a reasonable timeframe (typically 24 to 48 hours), straight wagers will be voided, and the stake will be refunded. In parlays, the canceled leg will be graded as "No Action," and the parlay's payout will be recalculated based on the remaining active legs.
5.4 Racebook Scratches
If a horse is scratched (withdrawn) from a race prior to the starting gate opening, all Win, Place, Show, and Exacta wagers placed specifically on that horse will be refunded. For complex exotic bets (such as Pick 3 or Pick 4), the scratched horse will typically be substituted with the post-time favorite, per standard racetrack rules.
6. Casino and Poker Room Rules
6.1 Fair Play and RNG
Our casino games utilize a certified Random Number Generator (RNG) to ensure that all outcomes (card deals, slot spins, roulette wheel drops) are completely random and statistically fair. The RNG is regularly tested and audited by independent, third-party testing laboratories. By playing in our casino, you accept that game outcomes are based entirely on chance.
6.2 Disconnection Policy
If your internet connection drops while playing a casino game, the following protocols apply: For slots, the spin will complete on our server, and any winnings will be credited to your account; you can view the result in your game history. For table games where user input is required (like Blackjack), the game will resume from the exact point of interruption when you log back in. In multiplayer Poker, if you disconnect during a hand, you will be given a set amount of time to reconnect; if you fail to act in time, your hand will be automatically folded.
6.3 Live Dealer Etiquette
When participating in Live Casino games, you are interacting with real human dealers. You must conduct yourself respectfully. Tipping the dealer is optional but appreciated. Any harassment or inappropriate behavior directed at the dealer or other players will result in immediate removal from the Live Casino and potential account suspension.
7. Bonuses and Promotional Offers
7.1 General Bonus Terms
Bovada routinely offers promotional bonuses, including Welcome Bonuses, Reload Bonuses, and Free Spins. All bonuses are subject to these Terms of Service and any specific terms outlined in the promotional offer. Bonuses are strictly limited to one per user, household, IP address, and device.
7.2 Rollover (Playthrough) Requirements
Before any bonus funds or winnings derived from bonus funds can be withdrawn, you must fulfill the specified "rollover" or "playthrough" requirement. This represents a multiplier of your deposit plus the bonus amount (e.g., 5x Rollover on a $100 deposit + $100 bonus means you must wager $1,000 before withdrawing). Different games contribute differently toward meeting rollover requirements; for instance, slots generally contribute 100%, while table games like Blackjack may only contribute 10% or 5%. Sportsbook rollover is calculated based on the lesser of the risk amount or the win amount.
7.3 Bonus Abuse
We reserve the right to review all accounts for bonus abuse. This includes, but is not limited to, opening multiple accounts, engaging in risk-free betting (e.g., betting on both red and black in Roulette) to clear rollover, or utilizing VPNs to mask your location to claim restricted offers. If we determine an account has abused a promotion, we will immediately confiscate the bonus, void any derived winnings, and potentially close the account.
8. Intellectual Property Rights
All content included in the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, video clips, digital downloads, game mechanics, software, source code, visual interfaces, and the overall "look and feel" (collectively, "Company Content"), is the exclusive property of Bovada or its licensors and is heavily protected by international copyright, trademark, patent, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial entertainment purposes. You may not copy, reproduce, scrape, reverse-engineer, modify, distribute, or create derivative works from any Company Content without our express, prior written consent. The "Bovada" name, logos, and all related product names are trademarks of the Company.
9. Disclaimers of Warranties
THE SERVICES, INCLUDING ALL GAMES, SOFTWARE, AND CONTENT, ARE PROVIDED TO YOU ON A STRICTLY "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOVADA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT OR GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR OWN SOLE RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOVADA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL ARISING FROM OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES SHALL BOVADA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) EXCEED THE EXACT AMOUNT OF FUNDS CURRENTLY HELD IN YOUR VERIFIED BOVADA ACCOUNT AT THE TIME THE CLAIM ARISES, OR ONE HUNDRED U.S. DOLLARS ($100.00), WHICHEVER IS GREATER. THIS LIMITATION OF LIABILITY CONSTITUTES A FUNDAMENTAL ELEMENT OF THE BARGAIN BETWEEN YOU AND BOVADA.
11. Indemnification
You agree to fully indemnify, defend, and hold harmless Bovada, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) that arise out of or relate to:
- Your access to, use of, or inability to use the Services.
- Your actual or alleged violation of any provision of these Terms of Service.
- Your violation of any third-party right, including without limitation any intellectual property, privacy, or publicity right.
- Your violation of any applicable local, state, national, or international law, rule, or regulation.
- Any claim that your use of the Services caused damage to a third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to fully cooperate with us in asserting any available legal defenses.
12. Dispute Resolution, Binding Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE YOUR CLAIM HEARD BY A JURY.
12.1 Initial Informal Dispute Resolution
We are highly committed to customer satisfaction. Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") informally by contacting our Customer Support team. We will work with you in good faith to reach a satisfactory resolution. You must provide a written notice outlining the specific nature of your claim and your desired outcome.
12.2 Agreement to Binding Arbitration
If the Dispute cannot be resolved informally within thirty (30) days of our receipt of your initial written notice, you and Bovada mutually agree that the Dispute shall be finally and exclusively resolved by binding, individual arbitration, rather than in court. The arbitration shall be administered by the International Centre for Dispute Resolution (ICDR) in accordance with its International Arbitration Rules. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of these Terms.
The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction thereof. The arbitration proceedings shall be conducted in the English language.
12.3 Class Action and Jury Trial Waiver
YOU AND BOVADA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND STRICTLY NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. Unless both you and Bovada agree otherwise in writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
13. Termination and Suspension
We reserve the right, in our sole and absolute discretion, to restrict, suspend, or permanently terminate your Account and your access to all or any part of the Services at any time, for any reason, with or without prior notice. Common reasons for termination include, but are not limited to, suspected violations of these Terms, involvement in fraudulent activities, money laundering, chargebacks, multi-accounting, or if we determine your continued use of the platform presents a risk to the Company or other players.
If your Account is terminated due to a violation of these Terms, you will immediately forfeit your right to any remaining balances, unredeemed bonuses, and pending withdrawals. If you wish to close your account voluntarily, you may do so at any time by contacting Customer Support, provided your account is in good standing.
14. Responsible Gaming
Bovada is dedicated to promoting responsible gaming. We recognize that gambling can become problematic for some individuals. We provide several tools to help you manage your play, including the ability to set self-imposed deposit limits, session time limits, and "cooling-off" periods. If you feel that you are losing control of your gambling habits, we strongly encourage you to request a Self-Exclusion, which will permanently block your access to the Bovada platform.
If you or someone you know has a gambling problem, please seek professional help immediately from organizations such as Gamblers Anonymous or the National Council on Problem Gambling.
15. Miscellaneous Provisions
- Governing Law: These Terms and any Dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the Union of the Comoros, without regard to its conflict of law principles.
- Severability: If any provision of these Terms is found by an arbitrator or court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision shall be deemed severed from the Terms, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
- Entire Agreement: These Terms of Service, combined with our Privacy Policy and specific betting rules, constitute the entire, complete, and exclusive agreement between you and Bovada regarding the Services, superseding all prior or contemporaneous oral or written agreements, understandings, or representations.
- No Waiver: Our failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. No waiver of any breach of these Terms shall constitute a waiver of any prior, concurrent, or subsequent breach.
- Assignment: You may not assign, transfer, or delegate these Terms or any of your rights or obligations hereunder, in whole or in part, without our prior written consent. Bovada may freely assign these Terms or transfer its rights and obligations to any affiliate, subsidiary, or successor entity without restriction.
- Force Majeure: Bovada shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, severe natural disasters, internet outages, cyber-attacks, or governmental actions.
